By booking, renting, or using equipment and services provided by Weekend Story (“we”, “our”, “us”), you agree to the following Terms & Conditions.

These Terms and Conditions also form the rental agreement between Weekend Story and the customer for the use, care and return of any equipment provided by Weekend Story. ‍

1. About Weekend Story

‍ Weekend Story provides Australia-wide camcorder rental kits and video editing services for weddings, birthdays, school formals, graduations, baby showers, first birthdays, milestone celebrations, holidays, and other special events. Our service is designed to allow customers and their loved ones to capture authentic footage using our equipment, which is then professionally edited into a personalised film.

2. Website, Online Store & Service Use

Age and authority to use this website

By using this website or placing a booking, you confirm that you are old enough to enter into a binding agreement in your state, territory or country of residence. If you allow a minor to access the website, use the equipment or participate in the service, you are responsible for their use and conduct.

Lawful and acceptable use

‍ You must not use our website, products, equipment or services for any unlawful, unsafe, harmful, misleading, offensive or unauthorised purpose. You must not use the website or services in a way that breaches any applicable law, regulation, venue rule, privacy obligation, intellectual property right or copyright requirement.

‍General service conditions

‍Weekend Story may refuse, cancel, suspend or limit a booking, order, website access or service where we reasonably consider it necessary, including where fraud, misuse, unsafe behaviour, breach of terms, incorrect information, payment issues or inappropriate conduct is suspected.

‍ Website and data transmission

‍You acknowledge that information you provide through the website may be transmitted across networks and processed by our website, booking, shipping, communication and service providers. Payment card information must only be provided through secure payment systems and is handled by the relevant payment processor. Weekend Story does not require customers to send card details by email, text message or standard website forms.

No unauthorised copying or commercial exploitation

‍ You must not copy, reproduce, duplicate, sell, resell, scrape, imitate, exploit or commercially use any part of our website, branding, content, packages, product descriptions, service process, images, videos, resources or customer communications without written permission from Weekend Story.

Information on our website

‍We aim to keep website information, package details, pricing, availability, images and descriptions accurate and up to date. However, errors, omissions or outdated information may occasionally occur. Website content is provided for general information only and should not be relied on as the only source of information where specific details are important to your booking. We may update, correct, remove or change website content at any time.

Pricing, availability and service changes

‍Prices, package inclusions, availability, rental periods, delivery options and services may change without notice before a booking is confirmed. Weekend Story may modify, pause, discontinue or replace any product, package, website feature or service at any time. Confirmed bookings will be honoured in accordance with the package and terms agreed at the time of booking, unless otherwise agreed in writing.

Products and services available online

‍ Some products, packages, add-ons or services may only be available through our website and may be limited by quantity, location, event date, delivery timeframe or equipment availability. Images are for general reference only. Rental equipment may show reasonable cosmetic wear from previous use, provided it remains suitable for normal use.

‍ Order, billing and account information

‍You agree to provide current, complete and accurate booking, billing, shipping, contact and account information. You must promptly notify Weekend Story if any relevant information changes, including your email address, phone number, delivery address, event date, return details or payment information. We may contact you using the details provided at the time of booking.

Third-party tools and platforms

Our website and services may use third-party tools, platforms or providers, including payment processors, booking systems, shipping providers, file delivery platforms, analytics tools and website plugins. These tools are provided by third parties and may be subject to their own terms, conditions and privacy practices. Weekend Story is not responsible for third-party platforms except to the extent required by law.

New website features or services

‍If Weekend Story introduces new website features, packages, tools, digital resources, products or services, they will also be covered by these Terms & Conditions unless separate terms are provided.

‍ ‍ ‍3. Bookings & Payments

·       All bookings are subject to availability.

·       Full payment is required to secure your booking date unless otherwise agreed in writing.

·       Your booking is not confirmed until payment has been successfully received.

·       Prices are listed in Australian Dollars (AUD).

·       Weekend Story reserves the right to update pricing at any time before a booking is confirmed.

4. Cancellation Policy

·       Cancellations made more than 60 days before the event date are eligible for a partial refund, excluding any non-refundable booking or administration fees.

·       Cancellations made within 60 days of the event date are non-refundable due to equipment reservation and scheduling commitments.

·       If your event date changes, we will do our best to accommodate a transfer subject to availability.

·       If Weekend Story is unable to fulfil your booking due to unforeseen circumstances, a full refund will be provided.

5. Shipping & Delivery

·       Australia-wide shipping is included unless otherwise stated.

·       Rental kits are shipped prior to your selected booking date.

·       Customers are responsible for ensuring accurate shipping information is provided.

·       Weekend Story is not responsible for delays caused by postal carriers, weather events, natural disasters, or circumstances outside our control.

·       Customers must return the equipment using the prepaid return label provided.

Checking Your Kit on Arrival

‍ Customers must check the rental kit as soon as possible after receiving it and notify Weekend Story promptly if any item appears missing, damaged or not working. If no issue is reported before the event, the kit will be treated as having been received complete and in working condition, unless proven otherwise. ‍

6. Rental Equipment

‍ Your rental may include:

·       Camcorder equipment

·       Batteries and chargers

·       Memory cards

·       Carry bags or suitcases

·       Instructions and accessories

‍ All equipment remains the property of Weekend Story.

‍ ‍Customers agree to:

·       Use equipment responsibly and with care

·       Keep equipment protected from theft, damage, water exposure, sand, excessive heat, or misuse

·       Return all items included in the rental package

·       Avoid modifying, dismantling, or repairing equipment

7. Damage, Loss & Theft

‍ Customers are responsible for equipment while it is in their possession.

‍ ‍Additional charges may apply for:

·       Lost equipment

·       Stolen equipment

·       Significant damage caused by misuse or neglect

·       Missing accessories or components

‍ Normal cosmetic wear from standard use is expected and will not incur charges. Weekend Story reserves the right to assess replacement or repair costs where necessary. The customer is responsible for all equipment, accessories, packaging and return postage materials from the time the hire package is delivered, collected or otherwise received by the customer until the package is safely returned to us. If any item is returned damaged, lost, incomplete, excessively dirty, late, altered, misused or unusable, the customer authorises us to charge the saved payment method for the reasonable costs associated with repair, replacement, missing items, cleaning, additional postage, late return fees and any loss of hire caused by the equipment being unavailable for another booking.

‍Repair costs may be charged up to $700. If the equipment is lost, stolen, not returned, or damaged beyond reasonable repair, the customer may be charged the full replacement value of the equipment and any included accessories. Late returns are charged at $50 per day from the day after the agreed return date until the package is returned, received by Australia Post, or otherwise resolved by us. By placing a booking, the customer agrees that we may use the saved payment method to recover these costs if required. We will only charge reasonable costs connected to the damage, loss, late return, missing items or breach of these Terms and Conditions.

8. Late Returns

‍ Rental kits must be lodged for return postage by the agreed return date. Late returns may incur additional rental fees of $50 per day until the package is returned or tracking confirms dispatch. Failure to return equipment may result in recovery action and replacement charges.

‍ ‍9. Footage & Editing Services

‍ Customers are responsible for capturing their own footage.

‍ While Weekend Story provides guidance and suggested shot lists, we do not guarantee:

·       Specific moments will be captured

·       Audio quality in difficult environments

·       Lighting conditions

·       Camera operation by guests or third parties

‍ Editing turnaround times may vary depending on workload, package selection, and seasonal demand. Final edited films are created in Weekend Story’s editing style unless otherwise agreed.

‍10. Raw Footage

‍Organised raw footage files are provided as part of selected packages. Customers are responsible for downloading and backing up delivered footage. Weekend Story is not responsible for long-term storage of footage after final delivery.

11. Customer Content & Usage Rights

‍ To the extent permitted by law, Weekend Story owns and retains all rights, title and interest in the footage, edited films, video files, photographs, creative edits, project files, templates, editing style and other content created, edited, produced or delivered as part of Weekend Story services. By booking or using Weekend Story services, the customer assigns to Weekend Story any rights the customer may hold in footage or content captured using Weekend Story equipment or created through Weekend Story services, to the extent those rights can legally be assigned. Weekend Story grants the customer a perpetual, worldwide, royalty-free licence to use, download, save, copy, share and enjoy the delivered footage and final edited films for personal, private and non-commercial purposes. The customer must not sell, license, commercially exploit, alter for commercial resale, or claim ownership of Weekend Story's footage, edits, project files, templates, creative work or delivered content without written permission from Weekend Story. The customer is responsible for ensuring that filming is appropriate for their event, venue and guests, including obtaining any required permission from venues, schools, hospitals, suppliers, guests, parents or guardians where required. Weekend Story may request permission to use selected footage, edited films or photographs for portfolio, website, social media or marketing purposes. Customers may request in writing that their content not be shared publicly, and Weekend Story will not knowingly publish private or sensitive content where a customer has made that request.‍ ‍

12. Errors, Inaccuracies & Website Updates

‍We take reasonable care to keep information on our website and in our booking materials accurate. However, from time to time there may be mistakes, outdated details or missing information relating to package descriptions, inclusions, availability, pricing, promotions, shipping costs, transit times, booking dates, images or other service details. Weekend Story may correct, update, change or remove inaccurate information at any time, including after an order or booking has been submitted. Where an error materially affects a confirmed booking, we may contact the customer to discuss the correction, adjust the booking where permitted by law, or cancel and refund the booking where appropriate. Unless required by law, we are not required to update every item of information on the website immediately. Any update date, refresh date or amended page should not be taken to mean that all website information has been reviewed or updated at that time.

13. Prohibited Uses

Customers and website users must not use the Weekend Story website, equipment, content, footage, services or booking systems for any unlawful, harmful, abusive, misleading or unauthorised purpose. Prohibited conduct includes using our website or services to break any law, infringe intellectual property rights, submit false or misleading information, harass or harm another person, interfere with website security, attempt unauthorised access, scrape or copy website content, send spam, phishing or malicious material, upload viruses or destructive code, collect personal information without permission, or use the service in a way that is obscene, unsafe, discriminatory, threatening or damaging to Weekend Story, our customers, suppliers or third parties. Weekend Story may refuse, suspend, cancel or terminate access to our website, bookings, products or services if we reasonably believe these Terms have been breached or our website, equipment, customers, business or third-party providers may be placed at risk.

14. Technical Issues

‍ ‍Weekend Story is not liable for footage loss caused by:

·       User error

·       Accidental deletion

·       Incorrect camera operation

·       Environmental conditions

·       Equipment misuse

·       Third-party handling

‍ If equipment experiences a verified technical malfunction during normal use, Weekend Story may offer a partial refund, replacement service, or other reasonable resolution at our discretion.

15. Warranties, Service Availability & Limitation of Liability

‍ Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights, guarantees or remedies the customer may have under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified. Subject to those rights, Weekend Story does not guarantee that the website, booking system, file delivery platforms, third-party tools or online services will always be uninterrupted, secure, available, error-free or free from technical issues. Customers acknowledge that digital services, postal services, payment systems, editing software, file transfer platforms and third-party providers may experience delays, outages, errors or disruptions outside Weekend Story’s reasonable control. To the maximum extent permitted by law, Weekend Story is not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of opportunity, loss of data, loss of enjoyment, emotional distress, replacement event costs, travel disruption, third-party actions, postal delays, event cancellations or missed footage, except where such liability cannot lawfully be excluded. Where Weekend Story is legally responsible for a loss, and where the law permits limitation, our total liability is limited to the amount paid by the customer for the relevant booking or service.

16. Indemnity

‍The customer agrees to take responsibility for claims, costs, losses, damages, expenses or demands arising from the customer’s breach of these Terms & Conditions, misuse of equipment, unlawful conduct, infringement of another person’s rights, failure to obtain required filming permissions, or actions of guests, invitees, contractors or third parties who use or handle the rental equipment during the customer’s booking. This includes reasonable costs incurred by Weekend Story in responding to third-party claims, recovering equipment, repairing or replacing equipment, addressing misuse of footage, or dealing with breaches caused by the customer or people connected with the customer’s event, except to the extent caused by Weekend Story’s own negligence or breach of law.

‍17. Severability

‍ If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the extent necessary. The remaining sections will continue to apply to the fullest extent permitted by law.

18. Termination

‍ These Terms & Conditions apply from the time a customer uses the website, places a booking, receives equipment or uses Weekend Story services. A customer may stop using the website or services at any time, but any obligations that have already arisen will continue to apply. Weekend Story may cancel, refuse, suspend or terminate a booking, service or website access where we reasonably believe the customer has breached these Terms, provided false or misleading information, failed to pay amounts owing, misused equipment, engaged in unsafe conduct, or placed Weekend Story, our customers, suppliers, website, equipment or business at risk. Termination does not affect any rights or obligations that arose before termination, including payment obligations, damage or replacement charges, late return fees, privacy obligations, content rights, indemnities and limitations of liability.

19. Refusal of Service

‍ Weekend Story reserves the right to refuse or cancel bookings where:

·       Fraudulent activity is suspected

·       Terms are breached

·       Unsafe or inappropriate conduct occurs

·       Equipment misuse is likely

‍20. Privacy

‍Personal information collected during bookings is used solely for:

·       Order processing

·       Shipping

·       Customer communication

·       Service delivery

‍ ‍We do not sell customer information to third parties.

‍ ‍21. Governing Law

‍These Terms & Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these terms shall be handled within the appropriate Australian jurisdiction.

‍22. Changes to These Terms

Weekend Story may update, replace or change these Terms & Conditions from time to time by posting the updated version on our website or otherwise making the updated terms available. The version that applies to a booking will generally be the version available at the time the booking is placed, unless a later change is required by law or the customer agrees to the updated terms. Customers are responsible for reviewing the current Terms & Conditions before placing a booking or continuing to use our website and services.

‍23. Entire Agreement

‍ These Terms & Conditions, together with any booking confirmation, invoice, package description, written agreement or policy referred to in these Terms, form the agreement between the customer and Weekend Story for the relevant booking or service. They replace any earlier discussions, messages, representations or understandings relating to the same booking or service, unless Weekend Story has agreed otherwise in writing. If Weekend Story does not immediately enforce a right under these Terms, that does not mean we have waived that right. Any uncertainty in these Terms should be interpreted fairly and consistently with their purpose, rather than automatically against either party.
